1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of Zellow.ai, its services, applications, websites, and any related tools (collectively, the “Services”) operated by Zellow.ai Inc (“Zellow”, “we”, “us”, “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
2. Eligibility
You must be at least eighteen years old to use the Services unless otherwise agreed in writing with us. If you are under eighteen, you may only use the Services with the consent of a parent or legal guardian.

To create surveys, access analytics, or manage data, you must create an account.
You agree to provide accurate and complete information during registration and keep it updated.
You are responsible for safeguarding your account credentials and for all activity under your account.
We reserve the right to suspend or terminate accounts that are inactive, fraudulent, or in breach of these Terms.
4. Scope of services
Zellow.ai provides:
Survey participation portals for respondents.
Private analytics dashboards and data insight reports.
We may update, modify, or discontinue any part of the Services at any time without prior notice.
5. Acceptable use
You agree not to use the Services to:
Violate any law, regulation, or third-party rights.
Upload, share, or transmit any content that is unlawful, defamatory, obscene, offensive, or harmful.
Upload malicious code, viruses, or other harmful software.
Misrepresent your identity or affiliation.
Collect data without proper consent or in violation of data protection laws.
Attempt to access, probe, or test our systems without authorisation.
Reverse engineer, copy, or attempt to replicate the Services without written consent.
We reserve the right to monitor usage and take appropriate action against violations, including suspension or termination of accounts.
6. Data ownership and rights
Anonymised data:
Once personal information from any survey is anonymised or aggregated so that individuals are no longer identifiable, all rights, title, and interest in that anonymised data shall belong exclusively to Zellow.ai Inc.
Zellow may store, analyse, licence, sell, publish, or otherwise use anonymised data without further consent or compensation.
Derived insights and analytics:
Reports, benchmarks, or analytics generated by Zellow using anonymised or aggregated data are the sole property of Zellow.
7. Intellectual property
All content, software, graphics, branding, and other materials provided through the Services are owned by or licensed to Zellow.
You may not reproduce, modify, distribute, or create derivative works from any part of the Services without our prior written consent.
Zellow grants you a limited, non-exclusive, non-transferable licence to use the Services for lawful purposes in accordance with these Terms.
8. Payment terms
Certain Services require payment of fees.
Fees are payable in advance unless otherwise agreed.
Late payments may result in not fulfilling or suspension of Services.
All payments are non-refundable except where required by law.
9. Third-party services and links
The Services may contain links to or integrate with third-party websites, tools, or applications. We do not control or endorse these third parties and are not responsible for their content or policies. Your use of third-party services is at your own risk.
10. Warranties and disclaimers
We provide the Services “as is” and “as available” without warranties of any kind, whether express or implied.
We do not guarantee uninterrupted or error-free operation, accuracy of insights, or that surveys will achieve a particular result.
We disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law:
Zellow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill.
Our total liability for any claim relating to the Services shall not exceed the total amount paid by you to us in the six months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Zellow, its officers, employees, and partners from and against all claims, damages, liabilities, costs, and expenses arising from:
Your use of the Services.
Your violation of these Terms.
Your breach of data protection or intellectual property laws.
13. Suspension and termination
We may suspend or terminate your account and access to the Services immediately if:
You breach these Terms.
We are required to do so by law.
We suspect unauthorised or fraudulent activity.
Upon termination, all rights granted to you under these Terms will end, but our rights to anonymised data and accrued payments will survive.
14. Changes to these Terms
We may amend these Terms from time to time. Updated versions will be posted on our website with a revised effective date. Continued use of the Services after changes means you accept the new Terms.
